"He is a conservator and, as a conservator, his role is to be burdened by, rather than benefit from, the conservatorship," Rosengart wrote in the document.
Popstar Britney Spears' attorney Mathew Rosengart has reportedly made a direct petition to remove her father, Jamie Spears, from her conservatorship because has been profiting from the arrangement. According to WWNO, the 120-page petition argues that Jamie should immediately be removed from overseeing Spears' funds. In the documents, Rosengart has alleged that the Toxic singer's father has been paying himself $16,000 every month since 2009 through his daughter's estate.
Insider states that the filings on July 26 mark the first time that Spears' legal team has formally moved to remove Jamie Spears from the conservatorship. The documents also included statements from the singer's mother, Lynn Spears, and co-conservator Jodi Montgomery to remove Jamie Spears as a conservator.
"Mr. Spears has profited handsomely from his daughter's conservatorship. By way of illustration only, since at least 2009, Mr. Spears has been paying himself $16,000 per month from Ms. Spears's Estate, $2,000 more than he has allotted to Ms. Spears," the document states, adding, "Mr. Spears also pays himself an additional $2,000 per month for office expenses — again, from Ms. Spears's Estate."
"In addition to that monthly compensation, Mr. Spears has paid himself a share of the revenues generated by Ms. Spears's performances. He reportedly received 1.5% of the gross revenues generated by Ms. Spears's performances and merchandise sales associated with her highly successful multi-year Las Vegas residency," the document revealed.
"He is a conservator and, as a conservator, his role is to be burdened by, rather than benefit from, the conservatorship," Rosengart wrote in the document.
Rosengart now wants to replace Jamie with Jason Rubin, a certified public accountant at Certified Strategies Inc, to manage her estate, which is worth $58 million, according to court documents obtained by PEOPLE. Rubin has reportedly practiced as a forensic accountant since 1993 and has testified as an expert witness in hundreds of cases.
"Ms. Spears respectfully submits that the Court should appoint her nominee; in that, it is an objectively intelligent preference to nominate a highly qualified, professional fiduciary in this circumstance," the documents read. "Moreover, Ms. Spears respectfully submits that, given the Court's recognition at the July 14, 2021, hearing that Ms. Spears has sufficient capacity to choose her own legal counsel, she likewise has sufficient capacity to make this nomination."
This is the latest update in the ongoing 13-year conservatorship battle since 2008, one that she was placed in after a public breakdown back then. Finally, on June 23, 2021, Britney Spears delivered an explosive testimonial in court, labeling the court-ordered arrangement as abuse. "I would like to charge my father with conservatorship abuse," she reportedly said in tearful testimony. "I want to press charges against my father today. I want an investigation into my dad."
In the second hearing, which took place on July 14, 2021, Spears scored a major win when the judge let her choose to hire her own attorney, which is how Rosengart is now representing her in court. Her next court date is scheduled for December 13, 2021.
