Daycare Worker Accused of Breaking Two-Year-Old Boy’s Leg: “I’ve Never Heard Him Cry Like That”

The toddler's parents are now suing the Las Vegas daycare facility.

A former employee at a Las Vegas daycare has been accused of breaking a two-year-old boy’s leg while he was under her care. The toddler's parents have since filed a lawsuit in the District Court of Clark County, Nevada. The lawsuit alleged that the May 12 incident happened at Crème de la Crème daycare. According to KTVU, the victim is listed as "B.R." and his parents were listed as "C.R." and "R.R." in court documents.

The lawsuit alleged that an employee told the parents that B.R. had been pushed down and injured by another child. After taking the young child to the hospital, an X-ray revealed that B.R.'s femur "had been severely fractured," according to court documents. The parents requested surveillance footage after suspecting their child had been abused. Attorney Janice Parker with Panish, Shea, Boyle, Ravipudi LLP claimed that the video showed an employee named Elicia Miller "picking up B.R. under the armpits and throwing B.R. across her body, from right to left."

According to I-Team, the video shows how the other children react to Miller's mishandling of the child in question. “They know what pain looks like and sounds like, and he … he was in pain,” the child’s father said, adding, “I’ve never heard him cry like that.” After watching the surveillance video, the parents were in shock. “I couldn’t believe what I was seeing,” the father said. “The fact that she aggressively threw him and he he was just standing there. He wasn’t doing anything.” Miller apparently apologized to the devastated dad. “She like profusely, apologized. ‘I’m sorry, I’m sorry,’ as she was walking by as I’m loading him in. And I … I just kind of brushed it off like, you know, like, I need … I need to go. I need to take care of him,” the father said. The child’s mother added, “He would shriek in a pitch that would break your heart.” Attorney Adam Ellis noted that the daycare delayed the child from getting immediate medical care. “If the investigation were different and cameras were reviewed and there were statements taken and taken more seriously and objectively, I think everyone would have realized this was a far more serious situation than they thought it was,” Ellis said.

Creme de la Creme offered this statement, "For 40 years, our number one priority is the safety and security of the children in our care. Immediately after this incident, we terminated the employment of the teacher involved." Recently, Elicia Miller accepted a plea deal on a charge of attempted child abuse. She will not go to jail but will have to enroll in anger management classes and perform community service," as per I-Team.
