Kevin Costner and Christine Baumgartner Have a Prenuptial Agreement in Place | His 1st Divorce Cost Him $80m

Christine Baumgartner has asked for shared custody of their three kids in the paperwork for separation.

As Kevin Costner and Christine Baumgartner split up after 18 years of marriage, they have a prenuptial agreement in place. Baumgartner filed for divorce on Monday, May 1, citing irreconcilable differences as the cause of the split, according to records obtained by PEOPLE.

Baumgartner, 49, placed their separation date as April 11 in her paperwork and asked for shared custody of their three kids, Cayden, 16, Hayes, 14, and Grace, 12. Costner also requested joint custody and cited irreconcilable differences in his statement, which was submitted on Tuesday. In addition, a prenup regarding spousal support, legal bills, and property is mentioned in the actor/director's filings.

A source shared with PEOPLE that the divorce wasn't Costner's idea. "It was not anything that he wanted or sought, and if he could change the situation, he would," the source said.

The "separate property" his legal team listed includes, "Miscellaneous jewelry and other personal effects; earnings and accumulations of the respondent before marriage, during the marriage, and from and after the date of separation; [and] there are additional separate property assets and obligations of each party as mandated by the parties' Premarital Agreement." They also add, "Pursuant to the terms in Paragraph 9.A. of the parties' Premarital Agreement, Petitioner to vacate Respondent's separate property residences."

Prior to their 1994 divorce, Costner and his first wife Cindy Silva were wed for 16 years. It is said that Costner paid his ex-wife an estimated $80 million in settlement, per PageSix. The Yellowstone star's settlement with Silva led to one of the most expensive divorces in Hollywood history. The protracted union between Costner and Silva, married in 1978, apparently ended due to rumors that Costner had been unfaithful. “I don’t know anyone who doesn’t know about him and other women,” a studio source said at the time about his affair with a hula dancer on set.

Costner had revealed just before the news of his first divorce emerged in the 90s that marriage was hard. “The temptations are pretty strong — and there’s a hungry world out there waiting for you to fall. So you can’t even dabble without paying a huge price,” he said, adding, “I try to conduct my life with a certain amount of dignity and discretion — but marriage is a hard, hard gig.”

In the joint statement that they issued to declare their divorce, Costner and Silva did not mention the affair. According to reports, Cindy received an $80 million settlement and joint custody of their three children, Annie, Lily, and Joe. They said at the time, “After 16 years together, we are ending our marriage. We have amicably resolved all issues regarding our children and financial affairs and a full marital settlement has been reached.”
