Kim Kardashian Files for Divorce From Husband Kanye West | Custody of Kids, Prenup, Spousal Support & More Details

The couple married in 2014 and have been facing issues for some time now. They have reportedly not been talking to each other since October.

Kim Kardashian and Kanye West's marriage seems to have buckled in the face of the 7-year-itch, which is a popular belief that happiness in long-term relationships declines around the seventh year together. The couple, who married in 2014, has been facing issues for some time now. Kardashian, 40, has decided to make things formal by filing for divorce from West, ending the "Kimye" era.

The Keeping Up With the Kardashians star wants joint legal and physical custody of their four kids: North, 7, Saint, 5, Chicago, 3, and Psalm, 21 months old. She listed "irreconcilable differences" as the reason for the divorce. She is also asking for their prenup to be enforced. It was signed before their wedding in May 2014. The SKIMS co-founder is also asking to terminate the court’s ability to award spousal support for either party, according to Us Weekly. The date of separation was listed as "to be determined." The KKW Beauty CEO had hired famed divorce lawyer Laura Wasser on "retainer" since the summer of last year.


Kardashian and West have not been speaking to each other since October, when they had a falling out during her 40th birthday party held at The Brando resort in Polynesia. Their argument there had started rumors about their separation, according to Dailymail.com. The conflict between them began further back in July 2020 when West chose to run for President of the United States. He went on a Twitter rant saying he wanted North aborted but Kim refused. He had also referred to his mother-in-law, Kris Jenner, as "Kris Jong Un."

The rapper also claimed that they were trying to keep him locked up. This has prompted the reality TV star to open up about his battle with bipolar disorder, which has reportedly taken a toll on their marriage.


The day she filed for divorce was a "somber day for him," a source told People. He "isn't happy" but "resigned to reality," the source added. "He knew it was coming, but that doesn't make it any easier," the source says.

Another source had said that the divorce filing had been amicable. Both of them agree over joint legal and physical custody. "It's as amicable as possible, but amicable doesn't mean joyful or ideal," the West source said. "It just means that they're being adults about the whole thing," they added.

"Kanye is seeing counselors and advisors to help him through this spot. It's rough for him, and he isn't happy," the insider adds. The filing came only days after a source said that the rapper was "not doing well." They added, "He is anxious and very sad. He knows that the marriage is over, and there's nothing that can be done right now." The source further said, "He also knows what he is losing in Kim."


As expected, Kardashian is also sad about the end of her marriage. "Kim is with her family today,” the source told People on the day she filed for divorce. "She is doing okay. She is sad, but ready to move on," they added. 

While the split was a long time coming, the Selfish author was reportedly "dreading" filing for it. "Their marriage has been broken for a long time," the insider said. "Kim feels like she has done everything she can to save it. Filing for divorce is something she has been thinking about for a long time. She has also been dreading it. She really, really has done everything to avoid filing," said the insider.

"Last year, she hoped they could somehow work things out," the source added. "In the past few weeks though, it has been clear that they are done. Although, there is still love, they are just too different and have different visions for the future."

Earlier, this year another source said, "They are just not on the same page when it comes to their future as a family and Kim is okay with it."
